AMIC Energy - Hands off Ukraine

Facing an all out invasion from Russia, Ukraine has taken emergency action against Russian linked western companies. It has seized the assets of AMIC Energy in Ukraine - an Austrian private equity firm, whose subsidiary AMIC Ukraine is one of the country’s biggest fuel retailers.

Now, the firm is threatening to use the fossil fuel industry’s favourite international agreement - the Energy Charter Treaty - to sue the government of Ukraine. Shockingly, the Austrian government has indicated its support for AMIC Energy in a joint press conference with the company. It is refusing to follow other states in withdrawing from the Energy Charter Treaty.

Dear colleagues,

Please accept our apologies for writing to you in English about this matter of major international concern, regarding the Government of Austria’s publicly stated support for AMIC Energy, an Austrian private equity firm that is currently suing the Ukrainian government over asset seizures.

On 18 August 2022, the Bureau of Economic Security of Ukraine (ESBU) seized the assets of one of Ukraine’s largest fuel retailers, AMIC Ukraine, the local subsidiary of AMIC Energy. They were acting on charges of tax fraud, money laundering and alleged connections with Russia.

AMIC Energy is now threatening Ukraine to use the discredited ‘Energy Charter Treaty’ to block Ukraine’s democratic decision to seize these assets. The treaty allows fossil fuel polluters to sue governments to recover compensation for investment losses. It has been described by the IPCC as having a ‘chilling effect’ on regulatory action for climate transition.

Some of Austria’s closest European allies already recognise that the Energy Charter Treaty is not fit for purpose and has got to go.. Germany, France, Poland, Spain and the Netherlands have all announced their intention to withdraw. Italy already withdrew from the treaty in 2015.

Shockingly, the Austrian government has indicated its support for AMIC’s litigation (the Ambassador of Austria spoke at a joint press conference with the company in Kyiv). Ukraine has a sovereign right to seize assets to protect its democracy and territorial integrity. Austria should be standing in solidarity with the people of Ukraine, not with the fossil fuel industry.

To withdraw your support for AMIC Energy’s immoral litigation against Ukraine.
Join your European allies in withdrawing from the Energy Charter Treaty.
